1. Acceptance of Terms
By downloading or using Precise Breath, you agree to these Terms of Service. If you do not agree, do not use the app.
2. Not a Medical Device
Precise Breath is a wellness and educational tool. It is NOT a medical device and is NOT intended to diagnose, treat, cure, prevent, or monitor any disease or medical condition.
The HRV analysis and resonant frequency estimates provided by this app are for informational and personal wellness purposes only. They do not constitute medical advice. Do not use this app as a substitute for professional medical advice, diagnosis, or treatment.
If you have any cardiovascular condition, heart arrhythmia, or other health concern, consult a qualified healthcare professional before using this app or any heart rate monitoring device.
3. Assumption of Risk
You use Precise Breath voluntarily and at your own risk. You are responsible for:
- Ensuring that breathing training is appropriate for your individual health status
- Using the app in a safe environment where slow, deep breathing poses no hazard
- Consulting a physician if you are unsure whether this type of practice is suitable for you
4. App Provided "As Is"
Precise Breath is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
Precise Breath, LLC does not warrant that the app will be uninterrupted, error-free, or free of harmful components.
5. Limitation of Liability
To the fullest extent permitted by applicable law, Precise Breath, LLC and its members, officers, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the app — including but not limited to loss of data, personal injury, or health-related outcomes.
Our total liability to you for any claim arising from use of the app shall not exceed the amount you paid for the app or in-app purchases in the twelve months preceding the claim.
6. In-App Purchases
Precise Breath offers a one-time in-app purchase ("Premium Unlock") that enables Resonate mode, Explore mode, Calibrate mode, Session History, and CSV export.
- One-time purchase: The Premium Unlock is a permanent, one-time purchase — there is no subscription.
- No refunds: All purchases are final except as required by the Google Play or Apple App Store refund policies applicable in your region. Refund requests must be made through the respective store.
- Restoration: If you reinstall the app or switch devices, you can restore your purchase through the store's standard restore-purchases mechanism at no additional charge.
7. Intellectual Property
All content, code, algorithms, and design elements of Precise Breath are the property of Precise Breath, LLC and are protected by applicable intellectual property laws. You may not reverse-engineer, copy, or distribute the app or its components.
8. Changes to the App or Terms
We reserve the right to modify or discontinue the app, or to update these Terms, at any time. Material changes will be posted at precisebreath.com/terms. Continued use of the app after changes are posted constitutes acceptance.
9. Governing Law
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts of Virginia.
